Car Rental Terms and Conditions

Effective date: 21 September 2026

1. Agreement and booking

These terms apply to bookings with TEXSPO TRAVEL SDN. BHD. (Registration No. 1566065-V), trading as Taxspocab. Self-drive conditions apply only when you rent a vehicle without our driver. For chauffeur-driven bookings, you are responsible for passenger conduct and the agreed itinerary; vehicle operation, fuel and motor insurance remain our responsibility unless a specific inclusion or charge is disclosed in your quotation.

Your booking confirmation records the vehicle category, dates, locations, rental charges, deposit and selected extras. A booking is confirmed when we issue confirmation after receiving the required payment. A payment receipt alone does not guarantee vehicle availability. We will refund any payment for a booking we cannot confirm. Please check your details and report errors promptly.

These terms and the quotation accepted before payment form your rental agreement. Any booking-specific variation must be clearly disclosed and agreed in writing before payment. Later changes require both parties’ agreement and cannot remove your statutory rights.

2. Driver eligibility

Self-drive renters and every additional driver must be aged 21–65, hold a full driving licence for the vehicle class for at least one year, and remain legally entitled to drive in Malaysia throughout the rental. Learner and probationary licences are not accepted. Foreign drivers must present their original national licence together with an International Driving Permit or translation where required for lawful driving in Malaysia; a permit does not replace the national licence.

Provide your MyKad or passport, driving licence and accurate contact details for verification. Bring the original documents at collection. Only drivers approved by us and recorded in the rental agreement may drive. You remain responsible for their use of the vehicle. We may refuse handover where documents are invalid, eligibility is not met, or driving would be unsafe.

3. Prices, payment and security deposit

Prices are in Malaysian Ringgit (MYR). The booking summary sets out the rental rate, rental duration, extras, discounts, applicable taxes and refundable security deposit before payment. Pay the amount requested through our authorised payment channel; any agreed outstanding balance must be paid before handover. Apply promotional codes before confirming payment.

The security deposit is separate from the rental price and is not a limit on liability. We return the undisputed balance within 14 working days after return and inspection. Working days exclude weekends and Malaysian public holidays. Any deduction must be itemised and supported by photographs, invoices, receipts or an official notice. We may retain only the amount reasonably needed for an unresolved charge and will explain the reason and update you within 14 working days. Later verified traffic fines may be billed separately.

Optional services, delivery, collection and additional-driver charges require your agreement before supply. No undisclosed administration or handling fee will be added.

4. Collection and vehicle condition

Collect and return the vehicle at the confirmed locations and times. At handover, check and record existing damage, fuel level, mileage, keys, accessories and safety equipment with our representative. Upload the requested before-and-after photographs through the booking page. Report any unrecorded defect before driving away; photographs do not waive your right to report a hidden defect.

We provide a clean, roadworthy vehicle. A model shown is subject to availability within the booked category. If we cannot supply it, we will offer an equivalent or higher category without extra rental charge, or a lower category with your agreement and a price adjustment. If no acceptable vehicle is available, you may cancel for a full refund including the deposit.

5. Rental period, extensions and late return

Your confirmed pickup and return times define the rental period. Request an extension before the return time; it takes effect only after we approve availability and you accept the additional price. Keeping the vehicle without approval does not extend the agreement.

A 30-minute return grace period applies. After that, late use is charged for each commenced hour beyond the scheduled return time at one twenty-fourth of the agreed daily rental rate, capped at one daily rate for each 24-hour period. The grace period is not added to an approved extension. Any necessary recovery cost must be reasonable and evidenced; we do not charge twice for the same loss.

Return all keys and supplied items to our representative. An unattended return requires prior written approval and instructions. Early return or late collection does not normally reduce the agreed rental price, except where we fail to provide the service or the law requires a remedy.

6. Fuel, mileage and permitted travel

Return the vehicle with the recorded collection fuel level, using the correct fuel. Missing fuel is charged at the actual replacement cost supported by a receipt, without an administration fee. Excess fuel is not refundable. For an electric vehicle, return it at the recorded charge level; any recharge cost must be documented.

Mileage is unlimited unless the quotation accepted before payment states an allowance and an excess-kilometre rate. Without an agreed allowance and rate, no excess-mileage charge applies. Use is limited to public roads in Peninsular Malaysia. Cross-border travel, ferry transport and travel outside this area require prior written approval and valid insurance for the journey.

7. Vehicle care and prohibited use

Lock the vehicle, safeguard the keys, follow warning indicators and use seat belts and legally required child restraints. Stop safely and contact us if a warning light, overheating, puncture or other fault makes continued driving unsafe.

  • No driving under the influence of alcohol or drugs, reckless driving, racing, speed testing or illegal activity.
  • No unauthorised driver, subletting, sale, pledge, driving instruction, or commercial passenger or goods transport without our written approval.
  • No towing, overloading, off-road use or driving into floodwater.
  • No smoking or vaping inside the vehicle. Do not carry durian, hazardous materials or anything likely to damage or contaminate the interior.
  • Do not tamper with the odometer, safety equipment, tracking equipment or vehicle components.

Normal cleaning and fair wear and tear are included. You pay only reasonable, documented additional cleaning or replacement costs for excessive dirt, smoke odour, stains, lost keys or missing items attributable to your rental.

8. Accidents, breakdowns and theft

Stop safely, assist anyone injured and call 999 in an emergency. Notify us immediately on +60 16-558 0298. For an accident or theft, make a police report promptly and, for a road accident, within 24 hours. Supply the report, photographs and relevant third-party details as soon as available. Do not admit liability or agree a settlement on our behalf.

Do not arrange repairs or towing without our approval, except where immediately necessary for safety or required by the authorities; keep receipts and notify us as soon as possible. Cooperate with the insurer and the investigation.

For a mechanical fault not caused by misuse, we arrange assistance and an available replacement. If we cannot provide a usable replacement, we refund the unused rental period. You are not responsible for normal mechanical failure or pre-existing defects.

9. Insurance and responsibility for damage

Motor insurance is subject to the vehicle’s actual policy, authorised drivers, permitted use and claim requirements. The cover, exclusions and any payable excess must be disclosed in writing before you accept the rental. No optional damage waiver is included unless expressly listed and paid for. A security deposit is not an insurance excess.

You are responsible for proven damage or loss caused by you or an authorised driver, subject to applicable insurance and any agreed excess or waiver. Where a breach or misuse causes a claim to be declined, we may recover the resulting reasonable, documented loss to the extent attributable to that conduct. A breach does not automatically make you liable for unrelated damage.

We do not charge for pre-existing damage, fair wear and tear, or losses already recovered from an insurer or another party. Repair, towing and necessary loss-of-use claims must be supported by evidence, reasonably mitigated and must not duplicate recovery. You may inspect the evidence and dispute a charge before it is finalised.

10. Cancellation and refunds

Send cancellation requests to support@texspocab.my or call +60 16-558 0298, quoting your booking reference. The time we receive your request determines the refund, using Malaysian time (UTC+8).

  • More than 48 hours before pickup: full refund of rental charges.
  • 24 to 48 hours before pickup, inclusive: 50% refund of rental charges.
  • Less than 24 hours before pickup or a no-show: rental charges are non-refundable.

The security deposit and charges for optional services not supplied are refunded in full when the vehicle has not been handed over. We do not deduct an additional payment-processing fee. A no-show means you have not arrived or contacted us within two hours of the agreed pickup time. Contact us before pickup if you are delayed.

If we cancel, cannot supply an acceptable vehicle, or refuse handover because of an error on our part, we refund all amounts paid, including the deposit. If handover is refused because you do not meet the stated driver or document requirements, the cancellation scale above applies. Your statutory rights remain unaffected.

Approved refunds are issued to the original payment method within 14 working days; your bank or payment provider may take additional time to display the credit. We will provide a refund reference on request. Date changes depend on availability and your acceptance of any price difference. If a change cannot be agreed and you cancel, the cancellation scale applies to the original pickup time.

11. Tolls, fines and other charges

You pay tolls, parking charges and traffic penalties arising from your use during the rental, including official notices received after return. We will provide the notice and rental details supporting any request for payment. You may dispute a notice through the issuing authority. No handling fee applies unless disclosed and accepted before booking.

We may provide driver and rental details to the relevant authority where lawfully required. Charges caused by our own conduct or outside your rental period are not your responsibility.

12. Termination and service interruptions

We may end a rental for a serious breach, unlawful use, unsafe driving or non-payment, and request safe return of the vehicle. Where it is safe and practical, we will explain the issue and allow a reasonable opportunity to resolve it. Recovery must be lawful and safe. Any final charge reflects services supplied and actual, evidenced loss; the deposit is not automatically forfeited.

If circumstances beyond either party’s reasonable control prevent the service, we will offer rescheduling or refund the undelivered portion and unused deposit. This does not exclude any remedy required by law.

13. Privacy, complaints and your rights

We process identity documents, contact information, booking records and condition photographs for verification, service delivery, safety, claims and legal obligations under our Privacy Policy. Where a vehicle has security or location tracking, it is used for vehicle safety, recovery and rental management as described in that policy.

Check the vehicle for your belongings before return. We take reasonable care of items found and arrange collection with you. Nothing in these terms excludes liability that cannot lawfully be excluded, including your applicable rights under Malaysian consumer law.

Malaysian law governs this agreement. Contact us first with your booking reference and supporting details so we can investigate. You retain access to the Tribunal for Consumer Claims Malaysia where eligible and the Malaysian courts. If a provision is unenforceable, the remaining provisions continue to apply.

14. Changes and contact

The version accepted for your booking continues to govern that booking. Updates apply to future bookings and do not retrospectively change an existing agreement without your consent.

For bookings, cancellations, assistance or complaints, email support@texspocab.my or call +60 16-558 0298. Include your booking reference when contacting us.
